Credit counselors provide debtors with sound advice for managing their debts. A key item they usually emphasize is the importance of deleting negative items from a consumer’s credit report. One strategy that can be used to achieve this is what is commonly called ‘Pay for Delete.’ In this strategy, a debtor negotiates with the collection agency regarding a full or reduced payment for a debt in exchange for the agency’s clearing up of the particular negative item in the debtors’ credit report.
This strategy has the potential of benefiting both the debtor and the collection agency. The debtor would gain a quick and substantial improvement on his credit score. At the same time, the collection agency stands to earn a good amount of profit from this method. Most of these collection agencies actually pay pennies for dollars to purchase debts from creditors. If the debtor has access to cash, and makes an offer to pay the full amount of the debt or even a portion of the debt, the collection agency would already be profiting from the deal.
The debtor, however, has to keep in mind that abiding by appropriate communication protocol is crucial to the success of this strategy. All communication regarding this negotiation should be in written form, and all forms of receipts and proofs need to be meticulously kept and filed. The debt collection agency needs to furnish documents acknowledging that a specified debt does indeed belong to the debtor. If ever the collection agency is unable to provide these documents, the debtor may write to the agency stating that even though the agency was not able to provide the debt validation documents, the debtor is still willing to pay the negotiated amount for the debt. This step is a less costly alternative to hiring lawyers and suing the agency in court. Following this, the debtor may now present his business deal. The offer should highlight the profits the agency can expect from the deal. It is very likely that the collection agency would accept the offer, and the debtor can expect the elimination of his debts and the deletion of the negative item from his credit report.
